Alive & Thrive Guarantee™
By placing an order with Nursery Plant, you agree to the following terms: We guarantee that your plants and trees will arrive healthy and happy. If you are unsatisfied with the condition of your plants upon receipt, we will provide a one-time replacement at no additional cost. Our Alive & Thrive Guarantee covers any issues with your plants within the first 30 days of receipt. Simply contact us by email at [email protected], and our team will review your concern. Should it be necessary, we will provide a replacement free of charge. Please note that plants need proper care and nutrients to acclimate to their new environment. If your plants receive less than optimal care or you purchase them outside of your recommended growing zone, your purchase will not be covered under the Alive & Thrive Guarantee. Additionally, if you purchase a deciduous tree during winter or early spring and it does not emerge from dormancy by May 30th, we will honor a replacement outside of the typical notification period. To receive this coverage, contact us by May 30th. Photos may be required to assist in troubleshooting your tree’s health, especially if it has experienced stress during transit.

Order Cancellation
Once you have completed the checkout process, your order is immediately fulfilled at our nursery, and your credit card will be charged. We take great care in selecting and securely packing your items, and because orders are processed and shipped so quickly, cancellations and changes must be made within four hours of placing your order. Once your order is packed and shipped, it cannot be canceled or altered. If you cancel your order after it has been processed but before it ships, a 25% restocking fee will apply. While we do our best to accommodate changes, once your order has left our nursery, it is literally out of our hands. Accidental Duplicate Orders
Did you accidentally place the same order twice? We will try to catch these errors on our end, but we need your help. Customers are responsible for contacting Nursery Plant immediately if they have accidentally submitted duplicate orders.

Shipping
We ship orders through USPS or UPS, depending on the size and weight of your purchase. Please allow up to 72 hours for order processing before shipment. Shipping costs are calculated at checkout based on the total weight and volume of your items.

We are proud of our 95% accuracy rate on shipping dates, though external factors can occasionally cause delays. As these shipping dates are estimates, we cannot guarantee exact delivery times. Occasionally, severe weather may impact shipping schedules. In such cases, we may delay shipping to protect the health of your plants. We will keep you informed as we prioritize the well-being of your order.

Spring Shipping
Some plants and trees are more sensitive to cold, making it important to ship them during months with milder temperatures. Items identified as spring-shipped are noted on their respective product pages. Additionally, some northern states can only receive shipments in the spring, and these areas are indicated. Although most plants and trees can be planted safely year-round, many gardeners prefer to plant during warmer weather. If you would like to delay your delivery date, please contact us at [email protected] and we will work with you to schedule your preferred shipping time.

Damaged Shipments
At Nursery Plant, we ensure that your order is carefully packed to survive transit. Although rare, packages may become damaged during shipping. If your package arrives damaged, please refuse the shipment. The delivery carrier will return the damaged package to us for a replacement. Do not attempt to plant a damaged plant, even if you believe it may recover. Notify us if you receive a damaged plant, and we will work with you to resolve the issue. Claims for damage must be submitted promptly for us to assist you.

Payment 
We accept major credit cards and PayPal for online orders. Payment is processed securely using SSL encryption to protect your information. Your order will only be processed once payment has been successfully received.

Returns
We do not accept returns for plants and trees to protect the health of our nursery and prevent potential contamination from pests or diseases. However, our Alive & Thrive Guarantee covers any issues within the first 30 days. If you experience an issue with your plants, please contact us by email at [email protected], and we will review your concerns. For garden supplies and hard goods such as fertilizers, planting mixes, containers, and tools, returns are accepted within 30 days of purchase, provided they are in their original packaging. The customer is responsible for return shipping costs, and there is no restocking fee for these returns. Before returning a garden supply or hard good, please contact us to inform us of the return.

Is My Tree Dead or Alive?
To check if your tree is still alive, perform a scratch test. Use a coin or fingernail to scratch the bark. If the layer underneath is green, your tree is alive. If it is brown or black, the tree is likely dead. Keep in mind that many trees and plants may appear to stall during dormancy, especially during the fall and winter months. In such cases, your tree may simply be conserving energy for future growth. Dormant trees and plants are often leafless and may drop their leaves after stress from transit or transplanting. Your tree should bounce back soon with proper care.

Mother Nature Disclaimer
Please remember that we cannot control all of the environmental factors that may impact your plants, such as extreme weather, pests, drought, or poor soil conditions. While we strive to provide the healthiest plants possible, we cannot guarantee their survival against factors outside of our control. We do, however, ensure that you are receiving a high-quality product. Plants are living organisms, and we aim to build trust and reliability with our customers.

Dormant Trees & Plants
Most trees and plants enter a dormancy or semi-dormancy phase in the fall through early spring. These plants may exhibit fewer leaves, discoloration, or complete leaf drop, which is normal and necessary for their health. Dormancy also makes the transplanting process easier and encourages root growth, providing a better foundation for the plant when it begins new growth in the spring. Please note that we do not accept claims for plant loss until dormant plants have been planted and given adequate time to exit dormancy.

Incorrect Orders
We make every effort to label and ship your plants correctly. If your purchase is mislabeled, we will replace the plant at no additional cost. Please contact us with photos of the mislabeled items so we can process your replacement.

Growth Rates
Growth rates listed on our site are based on ideal growing conditions, and individual results may vary. All plants are unique and require proper care in a suitable environment.

Pot Sizes
The container sizes listed on our product pages refer to industry-standard trade gallon measurements, which are smaller than conventional gallon sizes. Some plants may be pruned or repotted before shipping.

Bulk Orders
We guarantee that bulk orders will arrive in healthy condition and match the description in the signed Purchase Agreement. Bulk orders are not eligible for discounts or promotions, and all sales are final.

Coupons and Discounts
Only one coupon code may be applied per order. Coupons cannot be combined with other offers or discounts. Coupons must be applied at the time of purchase.

Governing Law and Dispute Resolution
All matters related to your use of the site will be governed by the laws of the State of South Carolina, USA. You agree to submit to the jurisdiction of state and federal courts in York County, South Carolina, for any disputes. Nursery Plant shall not be liable for damages exceeding the original purchase price of the products in any circumstance. If Nursery Plant prevails in a legal dispute, it is entitled to recoup attorney fees and legal costs.
